General Terms and Conditions of Auto Portal Schweiz | Autops.ch GmbH

1 Validity of the conditions
The services and offers of Auto Portal Switzerland are provided exclusively on the basis of these terms and conditions, even if they are not expressly agreed again. These terms and conditions are deemed to be accepted when the service is ordered. General terms and conditions of purchase of the buyer are hereby rejected. Deviations from these terms and conditions are only effective if we confirm them in writing.

2 Offer and conclusion of contract
The offers made by Auto Portal Switzerland in price lists and adverts are subject to change and non-binding. Orders are only binding for Auto Portal Switzerland after written confirmation. Order confirmations are only issued on express request.

3 Prices
The prices stated on our website are authoritative. For special services, the prices in the corresponding order confirmations apply.

4 Website uptime, maintenance
Auto Portal Switzerland ensures to the best of its knowledge and belief that the autops.ch website is available online. Auto Portal Switzerland accepts no liability for any website outages due to external influences. The website is maintained on a regular basis, which entails rare, brief interruptions in the availability of the website.

5 Cancellation/cancellations
Subscriptions can be cancelled or terminated at the end of the current term. Earlier cancellation of a subscription is only possible in exceptional cases and after consultation with and approval by Auto Portal Switzerland.

6 Abuse and ethics
The Auto Portal Switzerland website autops.ch may only be used to advertise vehicles. Uploading texts and images that are off-topic or ethically inappropriate will result in the exclusion of the seller in question from all Auto Portal Switzerland services. Any current subscriptions will be cancelled at the end of the current payment cycle. A refund of subscription fees is not guaranteed in this case.

7 Payment
Payments are made exclusively online via the webshop and must always be paid immediately.

If payments are not made promptly or correctly, Auto Portal Switzerland reserves the right to cancel the subscriptions or services ordered.

8 Limitation of liability
Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against us and against our vicarious agents, except in cases of wilful misconduct or gross negligence.

9 Copyrights
The seller is responsible for the uploaded texts and images and is solely liable for non-compliance with copyright infringements.

10 Data protection
Auto Portal Switzerland is authorised to process the data about the buyer received with regard to the business relationships or in connection with these, regardless of whether these originate from the buyer himself or from third parties, in accordance with the Federal Data Protection Act. Personal customer data will be treated confidentially and will not be passed on to third parties.

11 Competitions
All persons resident in Switzerland who have reached the age of 16 are eligible to participate. Employees of the competition organisers, competition clubs, automated services and other professionalised/commercial participants are excluded from participation. Participation in the competition is not compulsory. The prize varies depending on the content of the competition. Prizes that cannot be delivered to the winner at the address given when entering the competition within six months of notification will be forfeited without replacement. Prizes will not be paid out in cash. By entering the competition, you agree that, if you win, your first name and the first letter of your surname will be published on the autops.ch website. Legal recourse is excluded. No correspondence will be entered into about the competition, except with the winners. Only one entry per person is permitted and only with correct personal details. The competition organiser is entitled to exclude participants with a pseudonym, a falsified identity and participants with multiple registrations from the competition. The competition organiser also reserves the right to exclude participants from the competition if abuse and/or violations of these conditions of participation are suspected/detected or for other important reasons.

12 Place of jurisdiction
Däniken is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
